Contract / DisclaimerSAVANNAH PAINT & PLASTERQUOTE TERMS AND CONDITIONS1. Quote Validity1.1 This quote is valid for 30 days from the date issued. After 30 days, pricing and availability may change.2. Contract Price and Payment2.1 The quoted price includes all labor and materials for the stated scope. 2.2 Final payment is due upon Completion after the final walk-through (or waiver per Section 8). 2.3 “Completion” means the contracted scope has been substantially completed and the work area has been returned to normal use, subject to the Touch-Up Policy in Section 5.3. Deposit and Materials3.1 A deposit equal to 30% of the total contract price is required to reserve the scheduled start date. 3.2 The deposit must be paid no later than 48 hours before the scheduled start date to allow funds to clear and to allow Savannah Paint & Plaster to purchase and stage required materials. 3.3 The deposit is applied to the total contract price.4. Cancellation or Reschedule Before Work Begins4.1 If Customer cancels or reschedules the project after approval and before work begins, Customer agrees Savannah Paint & Plaster may retain from the deposit (and/or charge the card on file) the amounts below, not to exceed the deposit total: (a) Schedule Reservation Fee: 10% of the total contract price, agreed as liquidated damages for scheduling disruption and lost capacity, and not as a penalty. (b) Documented, non-refundable costs incurred prior to cancellation or reschedule, including materials purchased or specially ordered for the project, delivery fees, and other job-specific costs. 4.2 Any remaining portion of the deposit will be refunded within 10 calendar days after cancellation.5. Right to Cancel Where Required by Law5.1 For qualifying home-solicitation transactions, Customer may have a legal right to cancel within three business days, and Savannah Paint & Plaster will refund payments as required by law. 5.2 The Schedule Reservation Fee does not apply to cancellations made within any statutory cooling-off period where applicable.6. Scope Changes6.1 Any change to the scope after approval must be documented in a written change order and approved by Customer before work proceeds. 6.2 Requests to add, delete, or modify items must be submitted to Savannah Paint & Plaster by text or email. 6.3 Customer’s signature or approval confirms acceptance of the full scope and all terms, including the obligation to pay the total amount due upon Completion.7. Touch-Up Policy (Cosmetic Only)7.1 Customer has 7 calendar days from Completion to notify Savannah Paint & Plaster in writing (text or email) of any cosmetic paint touch-ups. Photos are required. 7.2 Approved cosmetic touch-ups will be completed at no additional labor cost and scheduled at the soonest available time window. 7.3 This Touch-Up Policy applies only to minor cosmetic corrections and does not cover conditions caused by building movement, settling, water intrusion, leaks, new damage, or pre-existing substrate or adhesion issues outside the stated scope.8. Touch-Up Appointment Cancellation Fees8.1 A card on file is required to reserve a touch-up appointment time window. 8.2 If Customer cancels or reschedules a scheduled touch-up appointment, the following fees apply: (a) 48+ hours’ notice: no fee (b) 24–48 hours’ notice: $100 (c) Less than 24 hours’ notice: $200 (d) Same-day cancellation or no-show: $300 8.3 These fees are agreed liquidated damages for scheduling disruption, administrative time, and lost capacity, and are not a penalty.9. Missed Appointments9.1 If Customer cancels or misses two scheduled touch-up appointments, the project will be deemed accepted as to cosmetic touch-ups, and no further cosmetic touch-ups will be owed under Section 7.10. Final Walk-Through and Payment Release10.1 Customer agrees to be reasonably available for a final walk-through after Savannah Paint & Plaster notifies Customer that the work is complete. 10.2 If Customer is unavailable, declines, or does not respond, Savannah Paint & Plaster may provide completion photos or video by text or email. 10.3 Customer must provide any punch-list items (if any) in writing (text or email) within 24 hours of the completion notice and photo delivery. Cosmetic items reported within that time will be handled under the Touch-Up Policy. 10.4 Final payment remains due upon Completion and is not conditioned on scheduling a later touch-up visit. 10.5 For out-of-area Customers who cannot attend, Customer waives on-site inspection and agrees photos or video provided by Savannah Paint & Plaster will serve as verification of Completion. Final payment is due within 24 hours of photo delivery.11. Late Payment and Collections11.1 Payment is due in full within 3 calendar days of invoice. 11.2 Amounts not paid by the end of day 3 will incur a one-time late fee of 3% of the total invoice amount (including tax). 11.3 Any balance that remains unpaid for 30 days or more will accrue interest at 1.5% per month (simple interest) on the unpaid balance until paid. 11.4 If an invoice remains unpaid, Savannah Paint & Plaster may pursue collection, including filing in magistrate court or other court of competent jurisdiction, and may seek allowable costs, interest, and other amounts as permitted by law.12. Notice to Consumer (Georgia Right to Repair Act)12.1 GEORGIA LAW CONTAINS IMPORTANT REQUIREMENTS YOU MUST FOLLOW BEFORE YOU MAY FILE A LAWSUIT OR OTHER ACTION FOR DEFECTIVE CONSTRUCTION AGAINST THE CONTRACTOR WHO CONSTRUCTED, IMPROVED, OR REPAIRED YOUR HOME. NINETY DAYS BEFORE YOU FILE YOUR LAWSUIT OR OTHER ACTION, YOU MUST SERVE ON THE CONTRACTOR A WRITTEN NOTICE OF ANY CONSTRUCTION CONDITIONS YOU ALLEGE ARE DEFECTIVE. UNDER THE LAW, A CONTRACTOR HAS THE OPPORTUNITY TO MAKE AN OFFER TO REPAIR OR PAY FOR THE DEFECTS OR BOTH. YOU ARE NOT OBLIGATED TO ACCEPT ANY OFFER MADE BY A CONTRACTOR. THERE ARE STRICT DEADLINES AND PROCEDURES UNDER STATE LAW, AND FAILURE TO FOLLOW THEM MAY AFFECT YOUR ABILITY TO FILE A LAWSUIT OR OTHER ACTION.
